It is now obvious that NE targets are more important than the public’s right of access especially for equestrians.

The statement made about not signing agreements until certain legal issues are sorted out was a gross distortion of the truth.

NE officers are only interested in signing conservation agreements and the local authorities with their management contractors are only interested in the money.

- I would recommend that Tony Barnett be included in a direct dialogue with yourselves(and legal team) as he is the single best equipped individual regarding Common Land and early English law.

Says Steve Yandall The incursions being made via Natural England into and onto Common Lands are failing to take due regard of our laws in that ownership of Common Land can only be established by "pre registration of title" that entails unequivocal proof of unbroken ownership predating 1189(date from memory).All claimed 'ownership' post that date confers vested and NOT ownership rights thus compromising agreements made on the basis of 'ownership'.

Within the issue of 'ownership' there also exists a 'brake' that stops owners conferring 'rights' as all Common Land rights are legally aportioned and cannot be compromised by 'owner' or commoner(or NE).Within that enclosures are also unlawful.

In most instances of NE undertaking agreements no owners exist thus exposing NE to potential litigation re mortgage fraud. Examples of 'owners' renting Common Land(thus denying Commoners Rights),non commoners paying for grazing,MOD claiming ownership, exist and these unlawful acts are condoned by NE financing the unlawful use of this land.

The 'sale' of Whitchurch Heath Common(sold as Prees Heath Common) without "pre registration of title" is an example of a sale/purchase involving public money and compromising Common Land law by extinguishing rights and natural phenomena for commercial and, ultimately,for use by a conservation charity.The holder of 'title' to Whitchurch Heath Common is Tony Barnett. The former is simplistic and multiple other legal 'infringements' await central attention but these matters are to be taken further however it is within your gift to review NE's part and drive change to avoid repetition.

I would recommend that Tony Barnett be included in a direct dialogue with yourselves(and legal team) as he is the single best equipped individual regarding Common Land and early English law.
