Says Tony BarnettI have been contacted by members of the public over concerns that the common lands and ponds, part of frensham common have been"stolen" by National trust and Waverley Borough council.

So, on behalf of your constituents and users of the ponds, that now know that the payments to use the ponds are criminal and that money has been taken from them unlawfully as neither have locus stan-di, what they now understand is that they to are guilty of the same wrongful acts because they to are charging members club fees.

Conclusive evidence of this information will be obtained from the Farnham angling society who pay £7,150 to national trust and Waverley council and payment for lease agreement to the two sailing and dingy sailing clubs, I have no information the fees paid by them.

The enforcement officer at Surrey County council Ian Gray is also the secretary of the angling club, I have requested that this person be prosecuted under the 2006 fraud act for none disclosure to his angling club members that the ponds are commoners rights and therefore fishing the ponds is forbidden, it is therefore on complaint he is duty bound to investigate but also the claims of ownership and rights by the council to regulate the common, affix signs and constructing works.

Jeremy you have my particulars, I am prepared , If nothing is done to remove the unlawful works and activities, apply under S 41 2006 CA to the county court for the works and unlawful activities to be removed and the common land reinstated.

Your involvement, we all feel assured will remedy this situation and the common land will once more be open from all points of view.

I am involved with common lands through out England and some parts of Wales, I know my strengths in common land legislation and the parts of the conveyance and criminal acts that run with common land issues.

I hope we can work together, it may cross your mind that this situation communities and local government minister and the policing and justice minister have a large proportion of this as their ministerial role, Pickles will never respond to any letters or emails.

To conclude, I have enough documentary evidence to go to court under S41.
