Padworth Common

Has West Berks Council something to hide?

Says Tony BarnettTony Barnett asked them to disclose documents;

pre registration of titles,
copies from the "common owners register
and the commoners rights register.

Now the Council have told him they "do not intend to engage with you any further in this matter"

Says Paul Hendry,
Countryside Manager, Planning and Countryside, Council Offices, Market Street,Newbury, Berkshire RG14 5LD

"You have been told on several occasions in the past that the Land Registry gave us Land Registry Title because we have the original Conveyance from the then Owner of the Common in respect of Padworth South.

To repeat what I have said in my previous email;

It is the authority's view that you are merely repeating requests that you have already have had answers to, and have no genuine purpose in continuing to raise these enquiries. In consequence we now consider your requests 'manifestly unreasonable' under Regulation 12(4)(b) of the Environmental Information Regulations 2004 and will not be responding further. A copy of the exception is attached.

If you are unhappy with the way your request has been handled, you may ask for an internal review. You should contact David Lowe, Scrutiny & Partnerships Manager, Strategic Support, Council Offices, Market Street, Newbury RG14 5LD, email dlowe@westberks.gov.uk within forty working days if you wish to request a review. If you are not content with the outcome of the internal review, you have the right to apply directly to the Information Commissioner for a decision. The Information Commissioner can be contacted at:

Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF www.ico.gov.uk

Hence I do not intend to engage with you any further in this matter."

Tony Barnett

replied to Paul Hendry

"PAUL,

I HAVE UNDERLINED YOUR STATEMENT WHICH YOU "REALLY NEED" TO SHOW A CONVEYANCE SOLICITOR, AS REGARDS TO NO FURTHERANCE OF RESPONSE TO REQUESTS, THEN PERHAPS YOU SHOULD APPLY FOR AN INJUNCTION."

I pine for a more sensible approach to saving our forests
