PREES HEATH COMMON AND PADWORTH COMMON

Sir Michael Pitt, Chief Executive, The Planning Inspectorate slams the door on Tony Barnett

"We will not therefore respond to any future correspondence from you unless new issues are raised."

Says Tony BarnettSir Mike Pitt writes to Tony Barnett

You question the correct registered identity of common land unit CL21. However, the land section of the commons register describes the land as Whitchurch Heath or Prees Heath. We are satisfied, therefore, that the references to the common in our decision of 19 August 2009 on Butterfly Conservations’ application (reference COM 64) are correct. As we have advised you on previous occasions, we are satisfied that Butterfly Conservations’ application was valid and properly made.

We cannot become involved in disputes about ownership, or allegations of illegal actions, in relation to common land. If you believe that criminal acts have taken place regarding these matters you may wish to contact the police if you have not already done so.

You say that with each consent a supplementary is issued; I assume you mean the covering letter to a decision. The purpose of the covering letter is to advise applicants that the decision only gives consent under section 38 of the Commons Act 2006 and it is the responsibility of applicants to ensure that they obtain any other consents, such as planning permission, which may be required.

We are currently dealing with an application from West Berkshire Council to erect fencing on Padworth Common. The Inspector appointed to decide the application will do so on its merits taking into account all relevant factors including any representations received from interested parties. Any comments you may have on the application should be sent (quoting our reference COM 292) to:-

Common Land Team 405 Kite Wing Temple Quay House 2 The Square Bristol BS1 6PN

As you say, you have e-mailed and written to us many times on these and other matters. We have responded to your concerns as fully as we can and there is nothing more we can usefully add. We will not therefore respond to any future correspondence from you unless new issues are raised.

Tony Barnett comments on Sir Mike Pitt's letter

"SIR MIKE PITT ENDORSED THE LEGALITY OF THE REGISTRATION, WELL THEN PERHAPS HE WILL NOW EXTINGUISH THAT REGISTRATION WHEN HE RECEIVES DOCUMENTATION TO SHOW THAT "COMMON HERITAGE 2001" REGISTERED A CLAIM TO THAT COMMON LAND SEE "PREES HEATH OWNERSHIP 15.7.02 (545.5KB) AFTER I HAD DEFEATED THE TWO PREVIOUS CLAIMS, WHICH WERE PHONED INTO THE COUNCIL."

Says Tony Barnett

Says Tony BarnettBUTTERFLY CONSERVATION SUPPORTED BY NATURAL ENGLAND'S "CHRIS HOGARTH" APPLIED AS OWNERS OF WHITCHURCH HEATH COMMON CL21, BUT USING THE AKA OF PREES HEATH COMMON CL21 TO OBTAIN PLANNING CONSENT FOR ENCLOSURE AND OTHER WORKS,AND THAT BUTTERFLY CONSERVATION HAD PURCHASED THE "WESTERN SIDE FROM PREES HEATH LTD", AND WERE THEREFORE OWNERS.

CL21 IS A REGISTERED No ATTACHED TO WHITCHURCH HEATH COMMON AND JUST AS CAR LICENCE IS NOT TRANSFERABLE, NEITHER IS A COMMON LAND REGISTRATION NUMBER, THIS, THE LOCAL AUTHORITIES WOULD KNOW.

SIR MIKE PITT ENDORSED THE LEGALITY OF THE REGISTRATION, WELL THEN PERHAPS HE WILL NOW EXTINGUISH THAT REGISTRATION WHEN HE RECEIVES DOCUMENTATION TO SHOW THAT "COMMON HERITAGE 2001" REGISTERED A CLAIM TO THAT COMMON LAND SEE "PREES HEATH OWNERSHIP 15.7.02 (545.5KB) AFTER I HAD DEFEATED THE TWO PREVIOUS CLAIMS, WHICH WERE PHONED INTO THE COUNCIL.

AS COMMON HERITAGE 2001 OF WHICH I AM THE CHAIRMAN HAS A REGISTERED SIGNED TITLE ON THE OWNERSHIP SECTION REGISTER FOR PREES HEATH COMMON CL21, ALBEIT FOR REFERENCE PURPOSES ONLY BECAUSE THERE ARE NO PREREGISTRATION OF TITLES, HOW THEN CAN THE COUNCIL , POLICE AND COURTS ALLOW FRAUDULENT CLAIMS TO BE SUSTAINED? I CAN ASSURE YOU WE HAVE NOT RECOGNISED THE CLAIM OR ENTERED INTO ANY AGREEMENTS.

COMMON HERITAGE HAS NEVER MISLED ANYONE, HAS NEVER OFFERED DEEDS OF GRANT OR CLAIMED ANY JURISDICTION ON OR OVER THE LAND, MY APPLICATION TO REGISTER THE AKA WAS TO HIGHLITE THE FRAUD AND CORRUPTION BY SHROPSHIRE COUNCIL AND THE EQUALLY FRAUDULENT CLAIMANT TO OWNERSHIP OF PREES HEATH COMMON CL21 "GRAHAM,JAMES, FITZHARDINGE BERKELEY, MR PREES HEAT Ltd).

HH CIRCUIT JUDGE MITCHELL HAS PREVIOUSLY REJECTED ALL SUCH CLAIMS TO OWNERSHIP OF THE AKA, AND HAS ALSO JUDGED AGAINST THE DEEDS OF GRANT MADE BY HIM AS UNSATISFACTORY IN LAW.

THE SAME BERKELEY HAS ALLEGEDLY CONVEYED PART OF THE COMMON UNDER THE TITLE OF THE AKA FOR £240,00 WHICH IS PART OF THE FRAUDULENTLY OBTAINED £571,000 FROM LANDFILL TAXATION, BECAUSE THE APPLICATION FORE FUNDING WAS ASSISTED BY THE BENT GOVERNMENT QUANGO "NE", NO FRAUD OR CRIMINAL ACTIVITIES HAVE BEEN ENACTED, YOU OR I, MAY BE MP'S WOULD NOW BE DOING TIME.
